The Occupational Safety and Health Administration (OSHA) and The
Construction Exchange of Buffalo & WNY, Inc. recognize the value of establishing a
collaborative relationship to foster safer and more healthful American workplaces. OSHA and
The Construction Exchange of Buffalo & WNY, Inc. hereby form an Alliance to use their
collective expertise to help foster a culture of prevention while sharing best practices and
technical knowledge.
OSHA and The Construction Exchange of Buffalo & WNY, Inc. agree to promote safe and
healthful working conditions for construction employers and employees in western New York by:
- Providing Construction Exchange members with information and guidance that will help
them protect employees' health and safety, particularly in reducing and preventing exposure
to the most prevalent construction industry hazards (e.g., fall hazards, struck-by hazards,
caught in/between hazards and electrical hazards).
- Increasing access to safety and health information and training resources.
OSHA and The Construction Exchange of Buffalo & WNY, Inc. will work
together to achieve the following training and education goals:
- Develop training and education programs on construction-related issues or targeted to
the construction industry in western New York.
- Deliver or arrange for the delivery of the 10-hour Occupational Safety and Health
Standards Course for the Construction Industry as well as the 30-hour Trainer Course for
Occupational Safety and Health Standards for the Construction Industry to the
members of
the Construction Exchange.
- Deliver training on construction-related safety and health issues to students in the
building trades at vocational schools in western New York.
OSHA and The Construction Exchange of Buffalo & WNY, Inc. will work
together to achieve the following outreach and communication goals:
- Develop and disseminate information through print and electronic media, including links
from OSHA's and The Construction Exchange of Buffalo & WNY, Inc.'s Web sites.
- Speak, exhibit, or appear at conferences, local meetings, or other events.
- Provide a Compliance Safety and Health Officer (CSHO), who is well-versed in safety
and health matters pertinent to the construction industry, to attend all quarterly
Construction Exchange of Buffalo & WNY, Inc. Safety Committee meetings.
- Cross-train OSHA personnel and construction industry safety and health professionals
in The Construction Exchange's best practices or effective approaches, as jointly
determined by OSHA and The Construction Exchange of Buffalo & WNY, Inc.
- Promote and encourage The Construction Exchange members' participation in OSHA's
cooperative programs such as compliance assistance, the Voluntary Protection Programs,
Consultation, and SHARP. In addition, The Construction Exchange will act as mentors to The
Construction Exchange members' worksites that aspire to excellence in safety and health.
- Share information on best practices, as jointly determined by OSHA and The Construction
Exchange of Buffalo & WNY, Inc. of The Construction Exchange members' worksites with
others in the industry through outreach by The Construction Exchange of Buffalo & WNY,
Inc. and through OSHA- or The Construction Exchange -developed training programs and
materials. Promote their implementation through print or electronic media, at conferences,
or by other means of outreach.
OSHA and The Construction Exchange of Buffalo & WNY, Inc. will work
together to achieve the following goals related to promoting national dialogue on workplace
safety and health:
- Raise others' awareness of and demonstrate their own commitment to workplace safety and
health whenever The Construction Exchange leaders address groups.
- Perform case studies and publicize their results through print or electronic media,
promotion at conferences, or other means of outreach.
- Convene or participate in forums, round table discussions, or stakeholder meetings on
construction industry safety and health topics to help forge innovative solutions in the
workplace or to provide input on safety and health issues.
- Share up-to-date information, such as injury, hazard, workforce trends and the most
frequently violated standards for the construction industry and other relevant enforcement
updates, that can be found on OSHA's web site, with The Construction Exchange of Buffalo
& WNY, Inc. on a quarterly basis.
An implementation team made up of representatives of both organizations
will meet to develop a plan of action, determine working procedures, and identify the roles and
responsibilities of the participants. In addition, they will meet at least quarterly to track
and share information on activities and results in achieving the goals of the Alliance. OSHA
will afford the opportunity for representatives of the New York State Department of Labor 21(d)
On-site Industry Consultation Service to participate as well.
This agreement will remain in effect for two years. Either signatory many terminate it for any
reason at any time, provided they give 30 days written notice. This agreement may be modified
at any time with the concurrence of both signatories.
